KP Introduces Foreign Marriage Rules for Civil Servants

The KP civil servants’ foreign marriage rules now require government employees in Khyber Pakhtunkhwa to obtain prior official permission before marrying a foreign national. The provincial government enforced the new framework with immediate effect after Chief Minister Sohail Khan Afridi approved the rules.

According to the notification, the Human Resource Management Department will treat failure to secure prior approval as misconduct. Officials who violate the rules may face departmental action under the relevant disciplinary laws.

The government has enforced the new framework under the title Khyber Pakhtunkhwa Civil Servants (Restrictions on Marriage with Foreign National) Rules, 2026, under Section 26 of the Khyber Pakhtunkhwa Civil Servants Act, 1973. The rules define a foreign national as anyone who is not a Pakistani citizen and apply to marriages conducted under any applicable law or religious custom.

Civil servants who want to marry a foreign national must apply through the proper channels and obtain prior government approval. Authorities will decide each case by considering the prospective spouse’s nationality, Pakistan’s diplomatic relations with that country, and any potential security or service-related implications.

The rules also require the foreign spouse to undergo security and credential clearance through the relevant agencies via the Home and Tribal Affairs Department. Applicants must submit supporting documents, including a character clearance certificate and an affidavit stating that the foreign national has no involvement in anti-state or criminal activities.

This added screening shows that the government wants to review such marriages not only as personal decisions but also through an administrative and security lens.

The notification says the government will also re-examine cases involving serving civil servants who are already married to foreign nationals without prior approval. Authorities will place those cases before the relevant forums for fresh consideration.

Any breach of the rules will constitute misconduct and could expose the employee to severe penalties under the Khyber Pakhtunkhwa Government Servants (Efficiency and Discipline) Rules, 2011. However, the government may relax the rules in specific cases if it records its reasons in writing.
