ISLAMABAD: The federal government filed a petition seeking review of Imran Khan’s hospital transfer order Wednesday, asking the Supreme Court to recall its order.
Islamabad Advocate General Naveed Hayat Malik filed the plea for the federal capital’s chief commissioner. The petition called the August 18 interim order “discriminatory” and beyond the court’s jurisdiction.
The government argued that Rule 197 of the Pakistan Prison Rules, 1978, governs hospital transfers for prisoners. It said authorities must follow that procedure except in emergencies.
Meanwhile, the petition cited Article 25 of the Constitution. It argued that allowing Imran treatment at a private hospital could prompt other prisoners to seek the same facility.
The government also raised due-process objections under Article 10-A. It said the court issued its interim directions before notices were served on all respondents.

The Supreme Court ordered the authorities to transfer the former prime minister to Shifa International Hospital within two days. A multidisciplinary medical board was to examine and treat him.
The court also allowed Imran’s personal physician and sister to remain involved in his care. It directed weekly family meetings and twice-weekly telephone calls with his sons.

However, the government’s review petition has not yet been fixed for hearing. The Supreme Court is scheduled to resume hearing the hospital-transfer petitions on September 16.
