The Supreme Court of Pakistan has dismissed all the concerns previously voiced by the Pakistan Democratic Movement (PDM) government concerning the composition of the five-judge bench presiding over the controversial audio commission case.
The bench, under the leadership of Chief Justice Umar Ata Bandial and inclusive of Justices Ijazul Ahsan, Munib Akhtar, Shahid Waheed, and Hasan Azhar Rizvi, had previously postponed pronouncing their decision regarding the inquiry commission spearheaded by Justice Qazi Faez Isa. The PDM government established this commission to scrutinize the alleged audio leaks.
The PDM government had raised eyebrows over the participation of several key figures on the bench, including the Chief Justice of Pakistan, Justice Umar Ata Bandial, Justice Ijazul Ahsan, and Justice Munib Akhtar, citing potential conflicts of interest.
Justice Ijazul Ahsan played a pivotal role in the case as he announced the reserved ruling on a petition presented by Supreme Court Bar Association (SCBA) President Abid Shahid Zuberi.
In the petition, the SCBA president had criticized the government’s objections as a direct assault on the judicial system’s independence, urging for the objections to be dismissed to uphold the sanctity of the judiciary. The pinnacle of judicial authority in Pakistan reserved its final opinion on this significant matter on June 6.
The Initial Formation and Tasks of the Commission
To provide further context, the Supreme Court of Pakistan initiated a halt on various petitions challenging the legitimacy of the judicial commission on May 26. This commission was brought into existence by the federal government of that time, with the primary objective of investigating the authenticity of the purported audio leaks that allegedly involved a Supreme Court judge and close kin of a prominent judge.
In the oversight of this mission was Justice Qazi Faez Isa, the next in line in seniority in the Supreme Court, following the Chief Justice of Pakistan. The commission also featured other distinguished members from the judiciary: Islamabad High Court Chief Justice Aamer Farooq and Balochistan High Court Chief Justice Naeem Akhtar Afghan, both of whom were entrusted with the task of ascertaining the truth behind the alleged audio leaks and ensuring justice is served.
