Imran Khan Seeks Bail in Supreme Court Over Controversial Cipher Case

Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan submitted a plea in the Supreme Court, requesting post-arrest bail concerning the cipher case. In his 18-page bail application, the PTI leader has presented 15 legal queries related to the case.

Khan’s primary concern is whether the cipher case is “politically motivated”. Furthermore, he has posed questions about the role of the Federal Investigation Agency (FIA) and its potential “malafide intentions”.

The Heart of Khan’s Questions

Khan’s questions target the jurisdiction of the case. “Was the Ministry of Interior correct in acting as the complainant and not the Ministry of Foreign Affairs, which deals with ‘Cypher Telegram’? Did the Minister of Interior, overseeing the FIA, act against Khan due to political differences?”

He also emphasized the possible oversight by the Islamabad High Court (IHC) regarding his prime ministerial immunity under Article 248.

On October 27, the IHC denied Imran Khan’s applications for bail and dismissal the first information report (FIR) in the cipher case. The FIR was filed against Khan and PTI’s vice chairman, Shah Mahmood Qureshi, for purportedly using a confidential document for political benefits.

The FIA, in its official document, has found both leaders guilty and has sought their prosecution. Additionally, former PTI secretary-general Asad Umar’s name was omitted from the accused list, while Khan’s previous principal secretary, Azam Khan, was dubbed a key witness.

The FIA has accused Khan of retaining and misusing a state secret. They also submitted evidence of speeches made by Khan and Qureshi, with Khan alleging interference from a foreign nation in Pakistan’s internal affairs.

The Ciphergate Saga

The entire controversy was sparked on March 27, 2022. Khan, in a public gathering, displayed a letter, which he claimed was a cipher from a foreign country that had collaborated with his political adversaries to overthrow the PTI government.

However, after investigations and leaked audio revelations, the cabinet in October 2022 decided to hand over the case to the FIA. Khan, alongside other PTI leaders, was summoned by the FIA. After a series of court orders, the FIA filed a charge sheet indicating Qureshi’s involvement with Khan in the episode. Both leaders have since denied all charges against them.
