US Political Ad Rates Fight Escalates After Court Ruling

WASHINGTON: A U.S. appeals court ruling on political ad rates has prompted competing warnings from Democrats and Republicans to television stations ahead of the November 2026 midterm elections.

The U.S. Court of Appeals for the Fourth Circuit ruled on Aug. 25 that political parties and joint fundraising committees with non-candidate members are not entitled to broadcasters’ statutory lowest unit charge.

The court set aside Federal Communications Commission guidance that would have expanded eligibility for those rates.

Candidates remain entitled to the lowest unit charge during legally defined pre-election periods. The ruling could therefore affect how far party-controlled advertising budgets stretch in competitive House and Senate races.

Democratic media buyers Miles King of Amplify Media and Bradley Perseke of GMMB warned stations that voluntarily extending discounted rates to outside.

Political groups could raise campaign-finance concerns, according to correspondence obtained by Axios. Both firms work with Democratic congressional campaign organisations.

Republican lawyers Ryan Dollar and Blake Murphy disputed that interpretation on behalf of the National Republican Congressional Committee and National Republican Senatorial Committee.

They argued that neither the court decision nor Federal Election Commission guidance prevents broadcasters from voluntarily offering lower rates to groups not legally entitled to the candidate discount.

The Republican attorneys also said they plan to appeal the Fourth Circuit decision to the U.S. Supreme Court and warned of FEC complaints.

Broadcasters adopt the Democratic interpretation for current advertising, having previously offered similar discounts.

The dispute comes during the final months of the 2026 campaign, when Democrats rely heavily on candidate-level fundraising while Republicans draw substantial resources from national party committees and outside organisations, according to Axios.
