A federal court in Oakland, California, dismissed Elon Musk’s lawsuit against OpenAI after a nine-person jury found his claims were filed too late, according to AP and The Verge.
U.S. District Judge Yvonne Gonzalez Rogers accepted the advisory verdict, ending Musk’s claims against OpenAI, Chief Executive Officer Sam Altman, President Greg Brockman and Microsoft.
Musk reacted on X after the ruling and accused the court of deciding the case on a “calendar technicality” instead of its merits. He said he would appeal to the Ninth Circuit Court of Appeals.
The xAI and SpaceX chief accused Altman and Brockman of “stealing a charity,” repeating his claim that OpenAI abandoned its nonprofit mission after he backed the original venture. OpenAI disputed Musk’s allegations in court.
The case focused on Musk’s claim that OpenAI shifted from its founding nonprofit structure toward a commercial model after he donated tens of millions of dollars. Financial Times reported that Musk said he gave about $38 million to the nonprofit.
The three-week trial included testimony from Musk, Altman, Brockman and Microsoft Chief Executive Officer Satya Nadella, according to AP. The jury deliberated for less than two hours before reaching its verdict.
Microsoft welcomed the ruling, The Verge reported, while Musk argued in his posts that the decision could harm charitable giving in the United States.
