The Islamabad High Court has clarified that dual citizenship does not disqualify an individual from serving as a judge.
The IHC’s statement from the Registrar’s Office in response to Senator Faisal Vawda’s inquiry concerning the eligibility criteria for judicial appointments.
The Court’s response highlighted that the Constitution of Pakistan does not prohibit individuals with dual citizenship or residency in another country from becoming judges. Additionally, it specified that information regarding dual citizenship is not a prerequisite for appointing lawyers as judges of the High Court.
Following a letter from six judges, the matter was brought into focus during a suo moto case proceeding that addressed a query about Justice Babar Sattar’s green card. After thorough consultations, the Supreme Judicial Council reviewed and approved Justice Sattar’s appointment.
Moreover, the Registrar’s Office noted that the Islamabad High Court does not maintain records of discussions within the Judicial Commission. A press release also disclosed that Justice Babar Sattar had previously informed the then Chief Justice of his green card status before his appointment.
