Three Supreme Court justices have formally expressed their concerns to Chief Justice Yahya Afridi and Justice Aminuddin Khan, the head of the Constitutional Bench, regarding the non-scheduling of the benches’ powers case.
Justices Mansoor Ali Shah, Ayisha Malik, and Aqeel Abbasi highlighted in their letter the failure to schedule the case for January 20, which they deemed a contempt of court.
The correspondence specifically mentioned Justice Aqeel Abbasi, who was appointed to the bench on January 16 and is familiar with the case from his time at the Sindh High Court.
The justices’ letter also referenced the January 17 session of the Practice and Procedure Committee. Justice Shah declared that he had previously stated his position on record and opted not to attend the committee meeting, noting that his presence was not obligatory.

The letter criticizes the committee’s decision not to reconstitute the earlier bench or to set a hearing for January 20, stating that failing to fix the case in court amounted to non-compliance with a judicial order and a violation of the law, constituting contempt of court.
Furthermore, the justices issued a show-cause notice for contempt of court to Additional Registrar Nazar Abbas for not scheduling the bench powers case for a hearing, underscoring the gravity of the oversight.
