The Supreme Court of Pakistan, led by interim Chief Justice Sardar Tariq Masood, heard the petition from Pakistan Tehreek-e-Insaf (PTI) regarding alleged election imbalances.
Justice Athar Minallah observed that PTI’s claims of being denied a level playing field in the upcoming general elections are “prima facie correct.” The three-member bench comprising Justice Mansoor Ali Shah discussed these concerns in depth.
The Supreme Court directed the Election Commission of Pakistan (ECP) to meet with PTI counsels to address the party’s apprehensions. The court ordered the attorney general to assist the ECP in this endeavour. Imran Khan’s lawyer, Shoaib Shaheen, raised issues of Maintenance of Public Order (MPO) orders against PTI leaders and obstacles in submitting nomination papers. Justice Masood questioned the ECP’s lack of action and assured a detailed decision after reviewing the complaints.
Resolution of the PTI Petition
The apex court disposed of the PTI’s petition after hearing arguments. Initially raised during the cipher case hearing, the petition pointed out hindrances PTI candidates face in filing nomination papers. The court’s decision aims to ensure fair and just electoral processes for all parties involved.
Through Barrister Gohar Ali, the PTI filed a petition alleging unfair treatment by district, provincial, and federal governments. They sought the court’s intervention to ensure a level playing field, arguing that the ECP and other authorities were legally obliged to provide an impartial environment for the elections. Despite the challenges, the PTI remains committed to participating in the democratic process without discrimination.
