The National Assembly of Pakistan ratified the Pakistan Army Act (Amendment) Bill, 2023.
The bill opens the door for penalties of up to five years of rigorous imprisonment for any individual found guilty of divulging information obtained in an official context that could be detrimental to Pakistan’s or the armed forces’ safety and interests.
Federal Law Minister Azam Nazeer Tarar introduced the bill, already sanctioned by the Senate, in the lower chamber of the parliament. Tarar clarified that the bill’s provisions don’t apply to civilians and will not affect ongoing Supreme Court cases.
Key Provisions of the Amendment
The legislation aims to alter the Pakistan Army Act 1952 to set the framework for the army’s establishment and maintenance. As per the proposed changes, the Pakistan Army can engage in activities related to national progress and advancing national or strategic interests upon receiving orders or agreements from relevant government bodies.
Furthermore, the bill restricts individuals with dual nationality from acquiring a commission in the armed forces. Under exceptional circumstances, it grants the federal government the authority to mandatorily retain any army personnel in service up to 60 years of age upon the army chief’s recommendation.
Additionally, the legislation states that individuals must abstain from all forms of political activity for two years from their retirement or departure from the service. For those involved in sensitive duties, this period extends to five years.
The amendment prohibits army personnel from accepting employment or consultation positions with entities having a conflict of interest with the armed forces’ activities without prior consent from the army chief. Violating this provision could lead to a sentence of up to two years imprisonment, a fine not exceeding Rs 0.5 million, or both.
Lastly, the legislation includes measures for electronic crimes. Specifically, it addresses actions that aim to undermine, mock, or defame the armed forces, outlining punishments for such offences.
