Mustafa Nawaz Khokhar, vice chairman of Tehreek Tahaffuz-e-Ain, has gone to Pakistan’s Supreme Court.. He asks the Court to enforce a PAPA decision. PAPA is the Court’s Practice and Procedure Committee.
On Oct. 31, 2023, the group voted 2–1. It sent the 26th Amendment cases to the full court for Nov. 4, but the hearing did not happen. Khokhar filed the case through lawyer Shahid Jamil Khan. He said the vote is binding under Article 184(3). No court office, he added, can set it aside.
He said courts must be free and fair. Ignoring the vote weakens the rule of law. It also harms fair trial and equal rights under Articles 4, 9, 10A, and 25. He also blamed Chief Justice Afridi. The Chief Justice spoke to judges in private and raised power issues. The filing said those reasons have no force in law.

It is called the missed hearing, an office error. It said this hurt the Court’s trust, openness, and teamwork. Delay, it added, denies quick and fair justice.
Earlier, Justices Mansoor Ali Shah and Munib Akhtar gave an order. They told the office to list the cases for a full court. The Chief Justice still chose a small bench after private talks with nine judges. Many lawyers say this move broke the group’s order and cut openness.

So the 26th Amendment cases are still pending. People also question the bench. Justices Shah and Akhtar still push for a full court. They say the change could have a big effect on the basic law. Khokhar’s filing warns of harm to fairness in the top court. The final ruling could shape the country’s law for years.
