A Florida judge appointed by Donald Trump has dismissed the criminal case against the former president. The case involved charges related to the mishandling of top-secret documents. This decision marks a significant legal victory for Trump, who faced allegations of endangering national security by retaining sensitive documents after his presidency.
Judge Aileen Cannon ruled in favour of Trump following arguments from his legal team. The team called for a reassessment based on a Supreme Court ruling regarding broad immunity for former presidents. The judge stated that the appointment of Special Counsel Jack Smith, who led the prosecution, was unconstitutional under the Appointments Clause of the U.S. Constitution.
The case dismissal comes at a critical time as Trump prepares to receive his party’s nomination at the upcoming Republican National Convention, shortly after an assassination attempt at a Pennsylvania rally.
The charges against Trump included 31 counts of willfully retaining national defence information, with each count carrying a potential 10-year prison sentence. Additional charges included conspiracy to obstruct justice and making false statements, stemming from allegations that Trump kept unsecured classified documents at his Mar-a-Lago home and obstructed federal efforts to recover them.
