On Friday, June 7, Harvey Weinstein, the former U.S. film producer, requested that his rape and sexual assault conviction be overturned and sought a new trial.
According to NBC, Weinstein made this appeal before a court in California, where he was sentenced to 16 years for these crimes,
Harvey Weinstein’s plea for a new trial is motivated by a recent decision by the New York Court of Appeals. In April, the court overturned his 23-year sentence, citing judicial errors in the 2020 trial. This case was significant as it ignited the #MeToo movement.
Weinstein is hopeful for a similar outcome in California, aiming to overturn his current 16-year sentence for rape and sexual assault.
The basis for the New York court’s decision was that the judge improperly allowed multiple women, who considered themselves victims of Weinstein, to testify. However, their accusations were not directly related to the charges being judged at the time.
NBC reported that Weinstein, at 72, is pursuing an appeal in the Second District Court of Appeal in Los Angeles. His publicist, Juda Engelmayer, criticized the trial, stating, “Harvey Weinstein was judged by a system dedicated to ‘get him’ at all costs.” He added that the appeal highlights nearly a dozen significant legal errors that, in their view, denied Weinstein a fair trial.
