The Election Commission of Pakistan has resolved not to de-notify members occupying reserved seats following recommendations of its Law Wing.
The ECP’s decision comes in response to the Supreme Court’s ruling, which did not annul but suspended the decisions of the Election Commission and the Peshawar High Court.
According to the Law Wing’s interpretation, the Supreme Court’s ruling allows for the suspension of membership but stops short of ordering de-notification. The Election Commission sought this legal opinion after the Supreme Court decided to ensure compliance with the court’s directives.
The Election Commission is planning further consultations and has scheduled a meeting for Monday to consider the Law Wing’s recommendations in detail. Additionally, the Commission anticipates seeking advice from the Ministry of Law to address all legal nuances thoroughly.
Pending these consultations, the Election Commission has opted to maintain the status of members on reserved seats, holding off any actions to de-notify them until a final decision is reached based on comprehensive legal advice.
