Andrew Malkinson Released After 17 Years, A Journey from Wrongful Conviction

Andrew Malkinson was released from a 17-year-long incarceration for a rape conviction he steadfastly denied. His dismissal came as fresh DNA evidence surfaced, connecting another individual to the crime.

Stepping out of the Royal Courts of Justice, an overwhelmed Malkinson expressed relief and resentment. His anger was particularly directed towards the Greater Manchester Police (GMP), who he accused of being willfully deaf to his cries of innocence and forcing him to endure an unfounded conviction.

Andrew Malkinson was previously found guilty of attacking a woman, even though 3 appeal judges were told there was "no forensic matter" linking him to the crime.

A Tumultuous Legal Journey and the Fight for Innocence

Malkinson’s journey through the legal system was arduous and distressing. His initial conviction relied solely on dubious eyewitness testimonies, devoid of incriminating DNA evidence. “I am innocent, and they finally listened today. But, I have been innocent all along,” he affirmed.

Throughout his imprisonment, Malkinson never ceased proclaiming his innocence. He refused to admit guilt for a crime he didn’t commit, a stand that he believes resulted in a decade-long extension of his sentence. “The GMP are frauds! I am not in denial, nor am I a liar. They are the ones in denial,” he reproached.

Malkinson’s case was revisited after new DNA evidence emerged, leading to the arrest of another suspect. His release resulted from the court’s ruling in his favour, following the GMP and the Crown Prosecution Service’s decision not to challenge his appeal.

The High Cost of Miscarriage of Justice

While his release marked a joyous end to his ordeal, the impact of his unjust imprisonment has left deep scars. Now unemployed, impoverished, and grappling with societal reintegration, Malkinson revealed the mental toll the experience had taken, “I spent 17 years always on guard, always counting down the minutes to lockdown so I could feel safe from other prisoners, safe from my thoughts, thinking I would die there.”

GMP’s Assistant Chief Constable Sarah Jackson apologised to Malkinson for the “gross miscarriage of justice” he suffered. However, the irreparable damage caused by his wrongful conviction and the years of liberty lost are stark reminders of the profound implications of a flawed justice system.
