Supreme Court Dismisses Petition Against Ex-ISI Chief Lt Gen Faiz Hameed

TopCity-1’s Chief Executive Officer (CEO), Moeez Ahmed Khan, filed a petition in the Supreme Court, alleging misconduct by former Inter-Services Intelligence (ISI) director general Lt Gen (retd) Faiz Hameed.

The petitioner accused Gen (retd) Hameed of land grabbing and stealing valuables during a raid on his house and office on May 12, 2017. The raid, according to Khan, was aimed at taking control of TopCity-1, a private housing society in Islamabad.

The matter was heard by a three-member bench of the Supreme Court, led by Chief Justice of Pakistan (CJP) Qazi Faez Isa, along with Justices Athar Minallah and Aminuddin Khan. During the hearing, the petitioner’s lawyer claimed that Khan and five colleagues were abducted and confined by Gen (retd) Hameed.

The Chief Justice questioned the legal precedents for such a case in the Supreme Court. It was also revealed that Zahida Javed Aslam, a Pakistani expatriate, had filed a petition in the SC’s HRC, alleging that Khan fraudulently transferred her properties in his name. Former CJP Saqib Nisar heard this case in the chamber.

Justice Minallah remarked on the legality of the human rights cell, stating that it was not established under any law. CJP Isa noted that both petitions fall under Article 184/3 but emphasized that Supreme Court proceedings should not occur in the chamber.

The Supreme Court ultimately disposed of Khan’s petition, advising him to seek other relevant forums for his grievances. The additional attorney general suggested that the Ministry of Defence could be approached and noted that retired military officers could face court-martial. Justice Minallah cautioned against overusing the Supreme Court’s powers under Article 184/3.
