President Alvi Refutes Signing of Official Secrets and Army Act Amendment Bills

In an unforeseen twist, Pakistan’s President Arif Alvi went public with claims that he had not assented to two significant bills in 2023. This revelation not only raised eyebrows but brought to the fore serious questions about the governance and decision-making process at the highest levels of the Pakistani government.

President’s Shocking Revelation

Taking to the microblogging platform, X, formerly Twitter, President Alvi stated that he did not sign the Official Secrets Amendment Bill 2023 and the Pakistan Army Amendment Bill 2023, even though news reports had indicated otherwise. He stressed that he had specifically instructed his staff to return unsigned bills. In a candid confession, he claimed that his directions had been ignored, stating, “I have found out today that my staff undermined my will and command.”

This acknowledgement raises many concerns, particularly in recent events where two PTI leaders, Shah Mahmood Qureshi and Imran Khan, faced legal challenges under the Official Secrets Act. The political environment is rife with tension, given the gravity of the allegations and their implications.

Fallout and Responses

Post President Alvi’s online disclosure, Pakistan Tehreek-e-Insaf (PTI), the ruling party, expressed astonishment. They emphasized the seriousness of this episode, labelling it as evidence of a “deadliest infection spreading from top to bottom in the state system.”

Political analysts and legal experts weigh in, opining that an apology from President Alvi might not suffice. Given the monumental oversight, they emphasize the necessity of legal proceedings against the staff involved.

It’s important to note the timeline of the approval process. The National Assembly greenlit the Pakistan Army (Amendment) Bill, 2023, on July 31, intending to penalize individuals who leak sensitive data concerning national security. Shortly afterwards, the Official Secrets Act received approval, just days before the dissolution of the National Assembly on August 7.

President Alvi’s reported signing of these bills drew criticism from the opposition and his party, PTI.

Understanding the Bills

The Pakistan Army (Amendment) Bill, 2023, aims to penalize those revealing confidential information that might jeopardize the security and interests of Pakistan or its armed forces. The act covers both serving and retired personnel of the Pakistan Army. It defines various powers, conditions of service, and other related operational matters.

On the other hand, the revised Official Secrets Act grants the FIA the authority to probe individuals suspected of breaching its conditions. One of the notable amendments in this Act includes the designation of an investigation officer from FIA, holding a position not below the rank of BPS-17. The bill also provides for forming a Joint Investigation Team (JIT) if necessary by the Director General FIA.

As the country grapples with these revelations, the road ahead remains uncertain. What’s clear, however, is that these events have further intensified the political dynamics of Pakistan.
