Trump’s Vow to End Birthright Citizenship: A Shift in Immigration Policies?

Donald Trump, the former President of the United States, has pledged to terminate the principle of birthright citizenship for the offspring of immigrants who reside in the country unlawfully.

Trump made the declaration through a video campaign message on Twitter, where he promised to enact an executive order instructing federal departments to cease granting immediate citizenship to children born to such immigrants.

The proposition contradicts the common interpretation of the 14th Amendment of the US Constitution, which provides citizenship to all individuals born or naturalized in the United States, independent of their parent’s immigration status.

The concept of birthright citizenship is deeply ingrained in the fabric of American society, stemming from the era following the Civil War and the abolition of slavery. However, Trump’s proposition seeks to alter this interpretation by stipulating that for a child to gain automatic US citizenship, at least one parent should be a US citizen or hold lawful permanent resident status.

While serving as President, Trump expressed a desire to curtail birthright citizenship via executive order, although he never acted on this intention. Nevertheless, legal professionals scrutinized the potential legality of such a move, as any endeavor to alter the principle of birthright citizenship would presumably encounter substantial legal opposition.

Simultaneously, Trump criticized President Joe Biden due to the record influx of migrants illegally crossing the US border. He asserted that birthright citizenship acts as a “magnet” luring illegal immigration, and he referenced other nations that limit this right for non-citizens. His hardline stance on immigration consistently resonated with the conservative wing of the Republican Party, and he pursued strict policies during his term, including attempts to construct a wall on the US-Mexico border.

Trump’s pledge to terminate birthright citizenship for offspring of unlawful immigrants aligns with his larger goal of clamping down on unauthorized immigrants and asylum-seekers. However, legal opposition to his executive order is anticipated if he emerges victorious in the 2024 presidential race and executes his proposed plan.

Parallel to this, Florida’s Governor Ron DeSantis, a potential Republican contender for the 2024 elections, has also prioritized immigration in his campaign. Recently, DeSantis enacted stringent immigration regulations in Florida, thereby positioning himself as a strong immigration enforcement candidate. He has also had disputes with Trump regarding their respective immigration strategies, with DeSantis accusing Trump of endorsing “amnesty” for unlawful immigrants.
